Terms

Twistly suggests roads. You drive them. This page is where that division of responsibility is written down.

1. Who these terms are with

Twistly is operated by [[LEGAL ENTITY NAME — NOT YET CONFIRMED]] [[COMPANY REGISTRATION NUMBER, OR SOLE TRADER — NOT YET CONFIRMED]], of [[POSTAL ADDRESS FOR LEGAL AND DATA-PROTECTION CORRESPONDENCE — NOT YET CONFIRMED]]. Using the site means accepting these terms. If you do not, do not use it.

Throughout, we and us mean Twistly, and you means whoever is using it.

2. Twistly is in beta

The site says so on its front page and it is not a pose. Features appear, change and are withdrawn. Route quality is the part still being worked on hardest. Data may be rebuilt, and a route generated today may not be generated the same way next month.

We may change or withdraw any part of the service, and we will not always give notice first.

3. What a route actually is

A route is a suggestion, not an instruction, and never a substitute for looking at the road. Twistly builds routes from OpenStreetMap data and its own measurements of it. Roads change, close, flood, ice over and get resurfaced. A road that was open when the data was built may be shut when you arrive, and a width or a surface recorded by a mapper may be out of date or simply wrong.

Drive to the conditions and obey the limits. Every speed limit, sign, weight restriction and closure on the ground takes precedence over anything Twistly shows you. Nothing in a route name, description or brief is an invitation to drive faster than is legal or safe.

Twistly does not measure, publish or rank how quickly anyone covered a road. There are no leaderboards, no records and no timings anywhere in the product, and there will not be. If you log a drive, that log is yours and stays private.

Check a route against a current map before you set off, and satisfy yourself that it suits your vehicle. A route that fits a motorcycle may not fit a camper van.

4. Your account

You need an account for some things and not for others. Keep your password to yourself; you are responsible for what happens under your account. The minimum age is [[MINIMUM AGE — NOT YET DECIDED]].

Tell us at hello@twistly.co.uk if you think someone else is using your account.

5. What you may not do

  • Break the law with it, or help anyone else to.

  • Post anything to a route, a comment or a photograph that is unlawful, abusive, or not yours to post.

  • Scrape, bulk-download or resell the road database. It is a derivative of OpenStreetMap data and stays on our servers; the generated routes are what the product gives you.

  • Work around the free-tier limits, whether by making extra accounts or by any other route.

  • Attack the service, or use it in a way that degrades it for other people.

  • Use the API or a connected agent to do anything you could not do in the app. The limits are the same on every surface.

6. Who owns what

  • The map data is not ours. Map data © OpenStreetMap contributors, under the Open Database Licence. Our scored road database is a derivative of it and is kept server-side.

  • The routes Twistly generates are produced works. They are ours, and you may use them — drive them, export them, share them, publish them, put them in a video. You do not need our permission and you do not owe us a credit, though the OpenStreetMap attribution should travel with any map you draw one on.

  • What you write stays yours. Comments, photographs and route names you write belong to you. By posting them you let us store and display them on Twistly.

  • Photographs on road pages are other people’s. They come from Wikimedia Commons under Creative Commons licences and are shown with their author and licence. Those licences govern what you may do with them, not these terms.

7. Payment

Twistly currently takes no money. There is no subscription to buy, no card details are collected and no payment processor is connected to the live site. The free allowance is a small number of route generations in a rolling 30-day window; when it runs out, it tells you.

If that changes, prices, billing terms and a refunds policy will be published before anything is charged, and this section will stop saying this.

8. What we do not promise

The service is provided as is and as available. We do not promise that it will be uninterrupted, that a route will be drivable, that a road will be open, that a stop will be trading, that an opening time is current, or that any measurement shown is free of error.

To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost data, or decisions you make on the strength of what Twistly showed you. Nothing in these terms excludes liability that cannot legally be excluded — including liability for death or personal injury caused by negligence, or for fraud.

If you are using Twistly as a consumer, your statutory rights are unaffected by anything here.

9. Ending it

You can stop using Twistly at any time. To have your account and its data removed, write to hello@twistly.co.uk; the privacy page says what happens then.

We may suspend or close an account that breaks section 5, or that we reasonably believe is being used to attack or abuse the service. Where it is practical and appropriate to do so, we will say why.

10. Governing law

These terms are governed by and construed in accordance with the laws of England and Wales, and disputes arising from them or from your use of the service are subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to these terms

We update the date at the top when the text changes. Continuing to use Twistly after a change means accepting the new version; if a change is significant, we will tell account holders rather than leaving it here to be found.
